However, they may not understand the other viable alternatives thousands of educators have exercised. Rather than the adversarial relationships unions rely upon in negotiations, educators have several proven alternatives.

Decertification

A union can always be removed through a legal process called decertification. In public schools, the removal of an incumbent union is controlled by state laws and a state labor board. In private schools and many charter schools, a union can be removed by a process governed by the National Labor Relations Board (NLRB).

Create An Independent Local

Rather than decertification and removing union representation entirely, another option is to remove the incumbent union and substitute an independent, local union made up strictly of your colleagues. Many educators elect to remove the corporate big labor component and establish a local bargaining unit. In such cases, the local typically has their own by-laws, partners with an attorney of their own choosing, and through this process, eliminates the many negative aspects of being affiliated with top-down, big labor unions like the NEA, AFT. Again, if you are employed in the public sector, the appropriate state board and laws overseeing employee relations govern how this can be done.
